تصاعد الاتتهاكات من قبل الاستخبارات العسكرية و الاجهزة الامنية بولاية جنوب كردفان an escalation the violations by the military intelligence and NISS in South Kordofan


تشهد ولاية جنوب كردفان منذ مطلع شهر سبتمبر حملة إعتقالات واسعة للمدنيين  من قبل الاستخبارات العسكرية التابعة للجيش السوداني و جهاز الامن والمخابرات الوطني  , حيث اشارات العديد من تقارير المنظمات العاملة في مجال حقوق الانسان , وتأتي هذه الاعتقالات مع إنتهاء ما يعرف باسم (موسم الخريف ) حيث تتصاعد بعده العمليات العسكرية ما بين القوات الحكومية وقوات الجبهة الثورية المعارضة التي تسيطر علي بعض المناطق بالولاية ,  هذا وقد رصدنا في حقوق عدد من الإعتقالات التي جرت خلال شهر سبتمبر الماضي بمدينة الدلنج  :-


- سيف  الدين يحي , قامت قوات تابعة لجهاز الامن والمخابرات الوطني  بإعتقاله بتاريخ 1 سبتمبر  , هذا و يملك خلوة اسلامية لتحفيظ القران بحي الوادي شمال شرق الدلنج .

- يوسف كرتكيلا مختار , قامت قوة تابعة للاستخبارات العسكرية باعتقاله  بتاريخ 3 سبتمبر من قرية الكرقل جنوب مدينة  الدلنج .

- حسبو بشير كافي (60 عام )  قامت قوة من الاستخبارات العسكرية بإعتقاله بتاريخ 6 سبتمبر 2014  من منزله بحي (الطرق) بمدينة الدلنج .

- بشير كنو (29 عام )  طالب بجامعة الدلنج , قامت قوة تابعة للاستخبارات العسكرية باعتقاله بتاريخ 8 سبتمبر  من حي التومات جنوب مدينة الدلنج .


- سالم يحي ابراهيم (26 عام ) قامت قوة من جهاز الامن والمخابرات الوطني باعتقاله بتاريخ 11 سبتمبر  اثناء سفره من مدينة الدلنج الي مدينة لقاوة .


- محمد النور كوكو (23 عام ) قانت قوة من الاستخبارات العسكرية  بإعتقاله  بتاريخ 29 سبتمبر من منزله بحي المك شمال بمدينة الدلنج ولتقوم بعدها بترحيله لي مدينة كادوقلي .



هذا ونتخوف في حقوق من إحالة هولاء المدنيين  الي سجون عسكرية او عرضهم علي محاكم عسكرية  , حيث جرت خلال العام الماضي محاكمة الطالب بجامعة الخرطوم سعيد محمد العوض (24 عام )  امام القضاء العسكري ,  كما تجري الان محاكمة عدد من المدنيين الذين تم إعتقالهم من  مناطق متفرقة من ولاية جنوب كردفان امام القضاء العسكري بالحامية العسكرية بمدينة الابيض بولاية شمال كردفان  ,  وذلك استنادا علي التعديلات التي اجازها  المجلس الوطني بتاريخ 2 يوليو 2013 في المادة الثانية من قانون القوات المسلحة التي  تسمح للسطات السودانية  بمحاكمة " أي شخص يرتكب جريمة تمس أمن الدولة " امام محاكم عسكرية" , كما تسمح هذه التعديلات ايضا للمحاكم العسكرية بمحاكمة المدنيين علي خلفية العدد من الجرائم بموجب القانون الجنائي لسنة 1991.

Since the beginning of September 2014, the state of Southern Kordofan has  witnessed a large-scale political detention campaign targeting civilians by the Sudanese Armed Forces' military intelligence as well as the National Intelligence and Security Services (NISS). This campaign comes after the end of what is known as the "Fall season" , when an escalation in military operations between the government forces and the Sudan Revolutionary Front (SRF) forces occurs since the SRF controls some areas of the state.
At Huqooq, we have monitored a number of arrests that occurred during September in Al-Dallanj city:-

-Seif Al-Deen Yahia, the NISS forces arrested him on the 1st of September, he runs an Islamic school for tutoring the holy Koran in Al-Wadi neighborhood in North-Eastern Al-Dallanj

-Yousif Kartilia Muktar, military intelligence forces arrested him on the 3rd of September in Al-Kargal village in the south of Al-Dallanj city

-Hassabo Bashir Cafi (60 years), military intelligence forces arrested him on 6 September in his house in Al-Torooq neighborhood in Al-Dallanj

-Bashir Kano (29 years), a student at Al-Dallanj university, military intelligence forces arrested him on 8 September in Al-Tomat neighborhood in Al-Dallanj.

-Salem Yahya Ibrahim (26 years), the NISS forces arrested him on 11 September as he travelled from Al-Dallanj to Leqawa city.

-Mohamed Al-Nour Koko (23 years), military intelligence forces arrested him on the 29th of September from his house in Al-Mek neighborhood, North of Al-Dallanj and he was then transported to Kadugli city.

At Huqooq, we are extremely worried about the transfer of the detained civilians to military prisons or subjecting civilians to military courts. In the last year, the University of Khartoum student, Saeed Mohamed Al-Awad, (24 years) was tried in a military court and currently, a number of civilians who were detained in different parts of Southern Kordodfan were tried in the military complex in El-Obeid city in Northern Kordofan state.

This injustice is prohibited based on the modification that was done to the second article of the Sudan Armed Forces law on 2 July 2013 that allows the Sudanese authorities to subject "anyone who commits a crime that impacts the national security" to the jurisdiction of military courts. The modifications also allows military courts to try civilians based on a number of crimes described in the Criminal act of 1991.
