Forced to fingerprint on a blank paper inside a court! الإجبار على البصم على ورقة فارغة داخل محكمة!

شهدت محكمة جنايات الخرطوم شمال  برئاسة القاضي عادل موسي أحمد في يوم الثلاثاء الموافق 30 يوليو 2013 محاكمة مجدي عكاشة أحمد علي الناشط بحركة (شرارة ) , وذلك أعتماداً علي بلاغ يحمل الرقم 3543 تم تحريره بتاريخ 4 ابريل 2011 الشاكي فيه

 جهاز الامن والمخابرات الوطني تحت المواد (77-69 ) من القانون الجنائي السوداني لسنة 1991.
وتعود تفاصيل القضية الي عام 2011 حيث  نظمت حركة (شرارة ) مظاهرة من جامعة الخرطوم وذلك في يوم 4 ابريل 2011  حيث تم اعتراضهم من قبل الطلاب الموالين للحزب الحاكم  بالجامعة والتعدي علي كل من (مجدي عكاشة أحمد علي - عمر بشير عبد  الملك الكنزي -عبد الرحمن محمود محمد عمسيب - برعي محمد عوض الله ) بالضرب ,  وتسليمهم بعدها لقوات الشرطة التي قامت بتسليمهم بدورها الي جهاز الامن والمخابرات الوطني حيث تم تقل مجدي عكاشة  الي مكاتب جهاز الامن والمخابرات الوطني بالخرطوم (الحرس الجمهوري ) لاستجوابه وتم نقل بقية المعتقلين إلى المستشفى الخرطوم  و ذلك  نظرا للاصابة التي تعرضوا لها ونقلوا   بعدها إلى قسم شرطة الخرطوم شمال حيث تم فتح بلاغ رقم 3543 تحت المواد (77-69) من القانون الجنائي السوداني لسنة 1991 من قبل جهاز الامن والمخابرات الوطني و شرطة النجدة والعمليات  , وتم اطلاق سراحهم في مساء يوم 5 ابريل 2011 بالضمان الشخصي .
وفي 25 يوليو 2013 وبعد مرور عامين علي الحادثة تم تسليم كل من ( مجدي عكاشة أحمد علي - عمر بشير عبد الملك الكنزي - عبد الرحمن محمود محمد عمسيب - برعي محمد عوض الله ) امر بالحضور لمحكمة جنائية الخرطوم في يوم الاثنين الموافق 29 يوليو 2013  , هذا و قد فصلت محكمة مجدي عكاشة عن بقية المتهمين حيث حددت جلسته في يوم الثلاثاء 30 يوليو 2013

 و في الجلسة الأولى و الوحيدة التي كانت يوم 30 يوليو 2013, إستمع القاضي إلى الشاكي من جهاز الأمن و الإستخبارات الوطني و لم يستمع لرد المتهم, و في نهاية الجلسة أخبر القاضي مجدي عكاشة بأن عليه التوقيع على تعهد للمحكمة بعدم المشاكرة في أي تظاهرات قادمة كما أخبره أنه سيتم إعتقاله حال رفضه التوقيع. و لقد قام أفراد جهاز الأمن الشاكيين بإحضار ورقة بيضاء فارغة تحمل ختم المحكمة و أجبروه على البصم في أسفل الورقة و قاموا بأخذ الورقة و لم يسلموها للقاضي و سمح له بالخروج. 




On Tuesday 30 July 2013, Khartoum criminal court Judge Adil Mousa Ahmed presided a session for Magdi  Akasha Ahmed Ali the activist in Sharara Movement (Spark), based on a complaint filed by NISS on the 4th of April 2011 and carries the number 3543 with article 69 and 77 of Sudan criminal code of 1991.

The details of this case goes back to the 4th of April 2011, Sharara Movement (Spark) organized an demonstration in the university of Khartoum, the demonstration have been attacked by the pro-government students and they also captured and handed; Magdi Akasha along with Omar Bashir Alkanzee, Abdelrahman Mahmoud Ahmed and Borai Mohamed Awad Allah to the police forces outside the university, then the police handed them to NISS officers which took Magdi Akasha to NISS offices near the presidential palace were he was questioned, and the rest of them were taken to hospital as they were severely injured and then they took them to North Khartoum police station.
 Magdi Akasha was taken later at the same day to North Khartoum police station were he joined the rest of the group, and on the eve of the 5th of April 2011  they were all released by warranty.
More than two years later on the 25th of July 2013 the court requested the four of them, Magdi Akasha court was separated from the others, and he went without a lawyer.

In the first and the only hearing which was in 30 July 2013,  the judge listened to the complainant (NISS) without listening to the defendant, and in the end of the session the judge told Magdi Akasha that he have to singe a commitment document to the court  that he will never participate in a demonstration again and he was also told by the judge that he will be arrested now if he did not sign. NISS officers the ones how filed the complaint against Magdi brought an blank white paper with the stamp of the court and forced him to fingerprint in the bottom of the paper and then NISS officers took it not the judge and they let him go.
